Enfin, sous la direction de MARTINEZ BARRIO et (142) FENNER, une suggestion de rupture de tous les pays avec le gouvernement de FRASCO a été distribuée dans les hôtels où logent les délégués. On affirme que INGALECIO PRIETO doit signer cet appel qui, malgré l'appui probable qu'il recevrait de Cuba, Colombie, Panama, Chili, Uruguay et Venezuela, ne sera sans doute pas soumis à la conférence.

Par contre, celle-ci (143) s'occupera certainement de la question du statut futur des bases navales et aériennes américaines et du régime des colonies européennes en Amérique en vue d'établir un front commun de toutes les nations américaines lors des discussions de San-Francisco.

D'après des informations recueillies par notre représentant a Berne, les mesures d'évacuation prises par les autorités allemandes dans la (ville) de Bade se heurteraient a la résistance passive de la population qui préférerait rester sur place plutôt que de connaitre la dure existence des refugies. C'est en vain qu'on la menacerait de sanctions telles que le retrait des cartes d'alimentation. Les chefs nazis se plaindraient de la voir suivre le conseil, donné par le BBC, de ne pas se replier a l'intérieur du Reich. On (1297) prétend en même temps que les Badols attendraient avec la plus grande impatience l'arrivée des troupes françaises. Par ailleurs, on rapporte de bonne source que dans la region de Fribourg-en-Brisgau et dans la vallée de la Miese, des tracts auraient été distribués aux soldats pour les inviter a déposer les armes et a créer des noyaux de résistance anti-nazie. L'ampleur prise par la diffusion de ces tracts laisserait a penser qu'ils émanent d'une organisation clandestine assez importante a l'intérieur du Reich.

Le projet de Dumbarton Oaks nous paraît, après attentif examen, non compatible avec les articles 3 et 4 du pacte franco-soviétique parce qu'il subordonne à une (autorisation) préalable du conseil de sécurité toute mesure de (répression) qui serait prise en exécution des accords régionaux (chapitre 6, section C, paragraphe 3). Or, à la différence du pacte anglo-soviétique le pacte franco-soviétique ne contient aucune clause d'adaptation à un système général de sécurité. Il convient de souligner (431) qu'une telle clause figurait dans l'avant-projet français et que c'est sur proposition soviétique qu'elle a disparu du texte définitif.

En acceptant de prendre le projet de Dumbarton Oaks comme base des travaux de la conférence de San-Prancisco, le Gouvernement soviétique n'a évidemment pas voulu renoncer à l'automatisme qui caractérise son traité avec la France. Veuillez donc lui demander comment il conçoit la coordination des deux instruments susvisés. Le Gouvernement français pour sa part se propose dans sa réponse au mémorandum dont il a été saisi par l'ambassadeur américain de faire une réserve sur le clause de Dumbarton Oaks concernant les accords régionaux.

Après des échanges de vues avec les Gouvernements américain et britannique qui se sont mis en communication avec le Gouvernement des Soviets, il a été convenu que le texte de l'invitation à la conférence de San-Francisco qui avait été communiqué par Ambassador des S.O. le 12 février serait modifié de la façon suivante:

"Les Gouvernements ci-dessus mentionnés suggèrent que la conférence considère comme offrant une base pour une telle charte les propositions pour l'établissement d'une organisation internationale générale qui ont été rendues publiques en octobre dernier après (188) la conférence de Dumbarton Oaks. Les mots "une base pour une telle discussion" (groups missing T).

En outre, il a été convenu qu'au moment où seraient lancées les invitations, Gouvernement Provisoire de la République publierait une déclaration annonçant comment la France acceptait de figurer parmi les puissances invitantes et précisant que, n'ayant pas participé à l'établissement du projet de Dumbarton Oaks à Yalta, Gouvernement Français consentait à ce que ces textes soient (pris) comme base de discussion mais tenait à faire connaître que certains amendements seraient nécessaires."
