Ministre de la Production industrielle a été informé par le U. que ce Département a en instance de signature un contrat de cession au Rubber Control de la prochaine récolte de caoutchouc de nos colonies d'Afrique. L'opération porte sur 13.000 tonnes environ. Cette cession peut constituer un (4020) atout non-négligeable dans les négociations que vous menez présentement à la d'assurer l'approvisionnement de la France en caoutchouc dans les cadres du plan de 6 mois. Notre situation se révèle particulièrement grave puisque les derniers stocks industriels de caoutchouc sont destinés à être épuisés d'ici quelques jours. Nous avons passé un accord avec le (4021) General Purchasing Agent pour approvisionner sur des contingents militaires les usines françaises de pneumatiques. Mais la moitié seule des articles ainsi fabriqués est destinée au marché français, la seconde moitié allant aux armées alliées.
Or, la capacité totale actuelle de production de nos usines dans les articles les plus nécessaires ne dépasse guère nos besoins minimum (4022) essentiels: par contre, rien n'a été fait pour approvisionner la branche caoutchouc industriel dont certaines fabrications sont fondamentales (courroies transporteuses, tuyaux, air ... pour les mines). Il appartiendra donc d'obtenir, en faisant valoir, entre autres, l'apport que constitue de notre part la cession de la récolte de nos colonies d'Afrique aux approvisionnements (pour les) alliés, une (4023) amélioration immédiate aux conditions de notre approvisionnement métropolitain. Cette cession pourrait comporter les mesures suivantes:
I envoi immédiate en France d'un petit tonnage de 1000 tonnes de caoutchouc au titre "civil affaire" pour couvrir les besoins minimum de fabrication caoutchouc industriel, en attendant réalisation des importations prévues au (4024) plan de 6 mois.
II assurance d'une amélioration en faveur de la France du partage de la production des usines françaises de pneumatiques

Comme ce fut déjà le cas souvent, et probablement à la suite d'instructions de Washington reçues par R. REHLE tard dans la soirée d'hiver, l'accord qui semblait presque réalisé n'a pu être obtenu. Il paraît maintenant voulu. Un texte américain et un texte anglais ont été mis en circulation cet après-midi.
## I. Les Américains proposent:
A) de supprimer à volonté de la convention les articles relatifs à la fixation des (quotas), l'attribution des capacités et aux privilèges spéciaux aux pays victimes de la guerre.
B) d'établir un protocole (92) annexé à la convention, instituant les cinq libertés sans autre contre-partie que d'une part la "clause canadienne", de retraitée à tout moment en ce qui concerne la seule cinquième, et, d'autre part, le droit pour un État de saisir le conseil s'il estime que l'activité d'un État lui cause préjudice. La direction de ce protocole serait facultative.
C) d'annexer un protocole équivalent à l'accord instituant l'organisation provisoire: tout État qui refuserait de le signer serait ramené à l'adoption en ses accords bilatéraux du modèle devant être établi par la troisième commission. (Two following messages missing).
